Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of Mail Genie ("Service"), which provides AI-powered email filtering for Gmail. Please read these Terms carefully before using our Service.

Signup requires a separate explicit acceptance of these Terms and confirmation that you are at least 18 years old. AI processing and recurring billing require their own choices.

Your Account

To use our Service, you must:

• Have a valid Google account and Gmail
• Provide accurate and complete information when signing up
• Grant our Service the necessary permissions to access your Gmail account
• Be at least 18 years old
• Maintain an active subscription to continue using the Service

You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to immediately notify us of any unauthorized access to or use of your account.

Service Description

Mail Genie is a subscription-based service that:

• Analyzes your emails using artificial intelligence to determine importance
• Applies labels to your Gmail messages (processed, black_hole, always_keep)
• Archives emails that don't require your attention
• Learns from your feedback to improve email classification over time
• Provides statistics and insights about your email processing

Mail Genie fetches message content when needed and keeps settings, policy, processing metadata and limited correction evidence. Legacy retained fields may include message details. Black Hole archives messages out of the inbox and supports restoration.

Subscription and Payment

Subscription Fee

Mail Genie is a paid service with a monthly subscription fee of $2.00 USD per month. This fee is charged monthly and automatically renews unless cancelled.

Payment Processing

• Payments are processed securely through Stripe
• You authorize us to charge your payment method for all applicable fees
• All fees are non-refundable except as required by law
• You are responsible for maintaining valid payment information

Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will continue to have access to the Service until the end of your paid period
• No refunds will be provided for partial months

You receive a retainable subscription acknowledgement and an annual reminder while automatic renewal remains enabled, including the amount, frequency, cancellation entry and support contact. For billing or cancellation recovery, contact john+support@analyticappetite.com.

Deleting your account cancels owned subscriptions immediately and ends service access before application data is removed. It does not create a final charge or automatic partial-month refund. Minimal acceptance and cancellation evidence survives deletion for the retention period described in Privacy.

Failed Payments

Failed payment can suspend subscription access. Check billing status or update your payment method through Manage/Cancel Subscription; payment retry timing is governed by the configured billing provider.

Google API Services

AI Processing

With your explicit consent, relevant sender, subject, message text and limited thread context go to TypeSafe Jev through Vercel AI Gateway for classification and Anthropic Claude for setup and learning. Provider terms govern their processing. Consent alone does not activate filtering. You can withdraw AI consent in Settings; processing then stops.

Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to interfere with, compromise, or reverse engineer any part of our Service
• Use the Service to process emails containing illegal content
• Share your account credentials with others
• Attempt to access other users' data or accounts
• Use the Service in a manner that could damage, disable, or impair our systems
• Engage in any activity that restricts others' use of the Service

Service Availability

We strive to provide reliable service, but we cannot guarantee:

• 100% uptime or uninterrupted access to the Service
• That the Service will be error-free or bug-free
• That email classification will be 100% accurate
• Specific response times for email processing

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Mail Genie and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain all rights to your email data. We claim no ownership rights over your emails or email data.

Data Processing and Privacy

By using our Service, you acknowledge that:

• Our Service accesses and processes your emails to provide filtering functionality
• We implement appropriate security measures as described in our Privacy Policy
• You have read and agree to our Privacy Policy
• AI processing requires separate explicit consent to the current provider disclosure; accepting Terms alone does not grant it

Limitation of Liability

In no event shall Mail Genie, its directors, employees, partners, agents, suppliers, or affiliates be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from errors in email classification or processing
• Any damages from missed or incorrectly classified emails
• Any unauthorized access to or use of our servers and/or personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any damages exceeding the amount you paid for the Service in the 12 months prior to the claim

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to defend, indemnify, and hold harmless Mail Genie and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you provide through the Service

Governing Law and Disputes

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination:

• Your right to use the Service will immediately cease
• Your subscription will be cancelled
• Application account deletion is completed after owned billing cancellation is verified; restricted financial evidence remains as described in Privacy
• You remain liable for all charges incurred up to the date of termination

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Sending email notification for significant changes

By continuing to access or use our Service after changes become effective, you agree to be bound by the revised Terms.
